UAE PASS Terms of Use

Welcome to UAE PASS.

The UAE PASS is provided by Digital Dubai Authority and the Telecommunications and Digital Government Regulatory Authority ("we", "us", "our").

UAE PASS services include electronic attestation certificates for electronic signatures and authentication provided by UAE PASS to the users of the UAE PASS applications, UAE PASS kiosks, UAE PASS website and/or future UAE PASS service channels (“Services”).

These terms and conditions (“Terms”) set out the basis upon which you (“you”, “your”, “user”) can access and use UAE PASS and the Services.

UAE PASS is for you to use with participating UAE government services. Whether you can use UAE PASS with any particular UAE government service depends on whether that service provider has integrated with UAE PASS. You should check with the relevant UAE government entity regarding which of its services UAE PASS can be used for.

1. Terms

   1. You will be asked to agree to these Terms when registering to use UAE PASS. Please read and understand these Terms. If you chose to register for or use any UAE PASS Services, these Terms will form an agreement between you and us for the use of UAE PASS and the Services. If you do not agree with any of the Terms, your sole recourse is to stop using UAE PASS and the Services.

   2. We may amend these Terms at any time by posting an updated version of the Terms on UAE PASS. We encourage you to check regularly for any amendments to the Terms and to read the Terms each time you use any Service.

   3. There is currently no charge for UAE PASS or any of the Services. We may introduce charging in the future but will notify you of any charges through UAE PASS before you use any Services which do become subject to charges.

   4. Please note that UAE Government e-Services linked with UAE PASS may have additional terms and conditions regarding your use of UAE Government e-Services. Nothing in these Terms is intended to modify UAE Government e-Services terms and conditions.

   5. These Terms apply to you whether you using UAE PASS as a natural or legal person. If you are using UAE PASS as a natural person on behalf of a legal person, you warrant that you have the required legal authority (i.e. delegation or power of attorney to do so).

   6. The service providers have the right to cancel/terminate the user’s registration at any time if they were legally incompatible, whether an individual or corporate party.

2. UAE PASS ACCOUNT

   1. You will need to register with UAE PASS to use Service(s). You must provide true, accurate, complete and current information (including name, date of birth, email address, Emirates ID, biometric data (if requested) and other details) as requested by us. You acknowledge and agree that:

      1. You must follow all directions provided by us in relation to recording and uploading of your information; and

      2. You grant us a royalty free right to use and store any information for the purpose of providing UAE PASS and the Services, subject to the Privacy Policy.

   2. You are solely responsible for the security of your username, password, registration information, and PIN and for any use of your UAE PASS account. You agree that you will:

      1. Not knowingly or recklessly use or attempt to use any UAE PASS Services, login, hardware, application, device or UAE PASS code for a purpose for which it is not intend, including any unlawful purpose; and

      2. Notify us immediately of any unauthorized activity regarding your UAE PASS account or other breach of security.

   3. We reserve the right to refuse access to UAE PASS or any Services, terminate accounts, at our sole discretion.

   4. You understand and agree that we are entitled to rely on:

      1. The authenticity of your username and password and where applicable any UAE PASS code; and

      2. Your consent to share your verified identity to access the participating service provider’s online service.

3. Privacy Policy

   1. The personal information (including any biometric data) you provide in the course of using the UAE PASS will be collected, stored and used in accordance with our Privacy Policy, the terms of which are hereby incorporated into and form part of these Terms.

4. License

   1. We grant you a limited, revocable, non-exclusive, non-transferable, worldwide license to download, install and use the UAE PASS application solely for your personal use strictly in accordance with present Terms. For avoidance of doubt, personal use includes the purposes verifying your identity where you are the authorized signatory of another legal person, such as a registered company.

   2. You may install the UAE PASS application on a device that you own or control.

5. Certificates

   1. The UAE PASS Services provides the processing and issuing of electronic attestation certificates for electronic signatures and authentication (“Certificates”) for users that are both natural and legal persons.

   2. You must confirm Certificate issuance in UAE PASS application. Corresponding confirmation is deemed Certificate acceptance for UAE PASS.

   3. The use of the User´s Certificates is prohibited for any of the following purposes:

      1. Unlawful activity (including cyberattacks and attempt to infringe the Certificate of the UAE PASS);

      2. Issuance of new Certificates and information regarding Certificate validity; or

      3. Enabling other parties to use your Certificate.

   4. Certificates become valid as of the date specified in the Certificate. The validity of the Certificate expires on the date of expiry indicated in the Certificate or if the Certificate is revoked.

   5. Please note that issuing you a Certificate does not entitle you to receive any particular service. Eligibility for services is a matter for the relevant participating UAE government entity. We provide no representation, warranty or endorsement of any third party provider.

6. USE OF UAE PASS

   1. You agree not to, and will not permit others to license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit any part of UAE PASS or the Services or make UAE PASS or the Services available to any third party through you.

   2. You must not conduct or promote any illegal activities while using UAE PASS. This includes any activities that (in our opinion), infringe on privacy or infringe any third party rights as well as activities that are defamatory to third persons. To do so may lead to prosecution.

   3. You must not use UAE PASS or the Services to generate unsolicited emails, spam or promotional materials to other users.

   4. You must not do anything to cause damage to UAE PASS or other users, including any technical damage to the other computers. You must not send any viruses or other material designed to adversely affect the operation of UAE PASS or the Services, affect any other users of the UAE PASS or affect any equipment or any data in the UAE PASS or the Services.

   5. You must not attempt to gain access to UAE PASS or the system that runs UAE PASS and the Services. You must not interfere with the security of UAE PASS, the Services, its system resources or network.

   6. You must not use UAE PASS in any manner that could damage, overburden or impair the UAE PASS or the Services or harvest or otherwise collect any information about the users. You must not link to UAE PASS without seeking our prior written consent.

   7. We do not guarantee that we will be able to prevent any illegal or inappropriate use of UAE PASS or the Services or will give notice of any illegal or inappropriate use of UAE PASS or the Services.

7. CHANGES AND CESSATION OF OPERATIONS

   1. We reserve the right to change or correct any errors or omissions in UAE PASS or the Services, and to alter, limit or discontinue the provision of any of the Services, at any time without prior notice to you. We will use reasonable efforts to include up-to-date and accurate information in UAE PASS, but we reserve the right to delete, modify, or supplement the content of UAE PASS or the Services at any time for any reason without prior notification.

8. THIRD PARTY LINKS AND ADVERTISEMENTS

   1. UAE PASS or Services may contain links to other websites. We make no representations or warranties as to the content, privacy practices and other practices of any websites operated by a third party and we do not assume responsibility for the content or practices of such websites. You should check the terms and conditions and privacy policies for all third party links/websites you visit to understand their procedures.

   2. If you use any material, or visit any linked website, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive material. We do not endorse and are not responsible for the use of, or the content of, any third party websites. We are not responsible for anything that may happen when you use them.

9. INTELLECTUAL PROPERTY

   1. We or our licensors own all intellectual property rights to UAE PASS and the Services. No license, right or other interest in UAE PASS or the UAE PASS application is granted to you except as expressly stated in these Terms. In the event of a third party claim that UAE PASS or possession or use of the Services infringes that third party’s intellectual property rights we will have sole discretion in relation to the investigation, defence, settlement and discharge of any such claim.

10. DISCLAIMER OF WARRANTY

    1. UAE PASS and the Services are provided on an “as is” and “as available” basis. We, our affiliates, and any of their owners, officers, directors, managers, members, agents, and employees, expressly disclaim (to the fullest extent permitted by applicable law) any and all express, implied, and statutory warranties, including, without limitation, any warranties of merchantability, fitness for a particular purpose, freedom from computer virus, title, and non-infringement of proprietary rights.

11. LIMITATION OF LIABILITY

    1. To the maximum extent permissible by applicable law, we and our subsidiaries, affiliates, and their respective suppliers, and any of their owners, officers, directors, managers, members, agents, and employees:

       1. Are not liable for any direct, indirect, punitive, incidental, special, or consequential damages or loss (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) arising out of, or in way connected with, the use or inability to use UAE PASS or any Services whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we are advised of the possibility of such damages; and

       2. Exclude any and all liability for damages caused by, any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any communications due to technical problems or traffic congestion on the internet or on UAE PASS or the Services or combination thereof, including any injury or damage to any users or to any person's computer related to or resulting from use of the UAE PASS or the Services.

12. INDEMNITY

    1. You agree to hold harmless and indemnify us and our subsidiaries, affiliates, and their respective suppliers, and any of their owners, officers, directors, managers, members, agents, and employees, from and against any claims, liabilities, suits, judgments, litigation costs, causes of action, demands, recoveries, losses, damages (actual and consequential), fines, penalties, and attorneys’ fees or other costs or expenses of any kind or nature arising from or in any way related to your use of UAE PASS or the Services, including, but not limited to those brought by you or on your behalf in excess of the liability described above, or by third parties as a result of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the UAE PASS or the Services.

13. NOTICE

    1. Any notices to you from us will be given by notices posted on the UAE PASS or sent by SMS or by email to the number and email address (as applicable) you provide to us during the registration process. Alternatively, we may give you notice by mail or courier to the address provided to us during the registration process.

14. ELECTRONIC COMMUNICATIONS

    1. To fulfill our obligations to you under these Terms, we may wish to communicate with you by SMS, email and/or by posting notices on UAE PASS or Services. You agree to receive communications from us electronically and that electronic communications will satisfy any legal requirement for communications, which need to be in writing.

15. TERMINATION

    1. We may terminate or suspend your access to all or part of the UAE PASS or the Services, without prior notice, if we believe that your conduct is in violation of these Terms, applicable law, or otherwise harmful to the interests of us or any third party. Notwithstanding such termination or suspension, you agree that you will continue to be subject to the obligations which, by their nature, survive such termination or suspension.

16. SEVERABILITY

    1. If any provision of these Terms is found to be invalid by a court or competent jurisdiction, that provision only will be limited to the minimum extent necessary and the remaining provisions will remain in full force and effect.

17. WAIVER

    1. Any failure by us to enforce any terms set out in these Terms or other policies with you is not a waiver of our rights to enforce those terms.

18. GOVERNING LAW AND JURISDICTION

    1. The Terms and your use of UAE PASS will be governed in all respects by the laws of the UAE.

    2. Any dispute regarding these Terms shall be subject to the exclusive jurisdiction of the Courts of the UAE.
